Abstract: | Even though the question of whether the EU should accede or not to the ECHR is no longer open for discussion, the terms under which the accession should take place is still very much an open issue. In fact, the more one looks into the matter, the more obvious it becomes that the forthcoming accession is like a conundrum – a myriad of problems, some of procedural, others of substantive nature, but all of them rather serious, become immediately apparent, while few solutions are readily available. Some of the more pressing problems will be closely examined, as well as the (un)acceptable solutions that have so far been aired. Special emphasis will be made on the consequences of accession on the area of freedom, security and justice in the EU, where a particularly tough dilemma, so far largely disavowed, needs to be resolved. |
