Abstract: The ICC is facing tough times in Africa today. Among the challenges is an effort by the African Union to establish a regional criminal court, which could seek to keep the ICC out of the continent altogether. If an African Criminal Court becomes operational, will it represent a decolonized form of international law, or an instrument in the hands of African heads to state to entrench impunity? Can the political problems witnessed with the ICC’s involvement in Africa be addressed by an African court with a reformed jurisdiction, or will the ICC’s pathologies only be reproduced on a regional scale?
